EGYM Cookie Policies - EUROPE

1. What are Cookies?

When you use our website, cookies are stored on your computer or your device (e.g. smartphone, tablet). Cookies are small text files that store information on the use of our website (e.g. websites visited, number of visits, visiting times, time spent on individual pages, browser used, operating system used, etc.) on your computer or device, if you allow this via the settings of your browser. Cookies cannot execute programs or transfer viruses to your computer.

In addition to cookies, so-called pixels (also called counting pixels, tracking pixels or web beacons) are used on our website. Pixels are small, non-visible graphics that are integrated into the website and which can also be used to evaluate information on the use of our website by website visitors.

2. For which purposes do we use cookies when you’re visiting our website?

We use cookies and similar technologies for the following purposes:

  • To authenticate our users (e.g. in the context of offers on our website which require registration). These cookies are necessary for the provision of our website.
  • For the user-friendly navigation and use of our website, in particular by storing user preferences (such as search or language settings). These cookies are necessary in order to provide you with our services.
  • For statistical evaluation and analysis of the usage behaviour (e.g. visited (sub-)pages, length of stay etc.) of our users (so-called web analysis cookies). With the knowledge gained, we can continuously optimise and improve our website.
  • For statistical evaluation and analysis of the success of our e-mail newsletters (e.g. opening rates, clicks on links etc.)
  • To display advertising tailored to your interests outside of our website

The cookies, pixels and similar technologies used by us do not store any personal data about you, but rather, depending on the cookie or pixel used, purely pseudonymous or anonymous usage data that cannot be assigned to your person.

The legal basis for the use of cookies and similar technologies on our website for the above-mentioned purposes is Art. 6 para. 1 s. 1 lit. f) GDPR (processing is necessary to protect the legitimate interests of the controller). Further details can be found below in the list with the individual cookies/tools used on our website.

3) Cookies, pixels and similar technologies used on our website

Below you will find information on the individual cookies and tools from us and third parties used on our website for these purposes. Under each tool used, you will also find information on how you can object to the use of cookies and similar technologies for web analysis and advertising purposes (so-called "opt-out"). General information on the deletion of cookies can also be found below in section 4).

a) Necessary cookies/services:

Google Tag Manager

We use the Google Tag Manager of the provider Google Inc., which enables us to integrate and manage so-called website tags or markers on our website interface (via this we can, for example, integrate the service Google Analytics on our website). Website tags themselves are small code elements that can be used, for example, to measure traffic on our website and user behaviour. The Tag Manager itself (which implements the tags) is a cookie-free domain and does not process any user data.

b) Analysis cookies/services:

aa) Use of Google Analytics

This website uses Google Analytics, a web analysis service of Google Inc, USA ("Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there. We have activated IP anonymisation (by the extension "_anonymizeIp()) on this website, so that your IP address is, however, previously shortened by Google within member states of the European Union or in other states which are party to the Agreement on the European Economic Area, in order to exclude the possibility of personal references. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. On our behalf, Google will use this information to evaluate your use of the website, to compile reports on the website activities and to provide further services to the website operator in connection with the use of the website and the Internet. The IP address transmitted by your browser within the framework of Google Analytics is not combined with other data from Google.

We have a legitimate interest in analysing and statistically processing the use of our website by website visitors. By means of the statistics obtained, we can constantly improve our website and make it more interesting for you as a user. The legal basis for the use of Google Analytics is Art. 6 para. 1 sentence 1 lit. f GDPR (processing is necessary to protect the legitimate interests of the controller). Google has subjected itself to the EU-US Privacy Shield https://www.privacyshield.gov/EU-US-Framework.

Opt-out: You can prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) to Google and the processing of this data by Google by downloading and installing the browser plug-in available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

bb) Pardot

This website uses the services of Pardot for sending newsletters. The provider is Salesforce.com, inc. The Landmark at One Market, Suite 300, San Francisco, CA 94105, USA. Pardot is a service with which the sending of newsletters can be organized and analyzed. If you register for our newsletter, the data you enter is stored on Pardot's servers in the USA for the purpose of receiving the newsletter (e.g. e-mail address). Pardot is certified according to the "EU-US Privacy Shield". "Privacy-Shield" is a framework between the European Union (EU) and the USA, which is intended to ensure compliance with European data protection standards in the USA.

With the help of Pardot we can analyze our e-mail/newsletter campaigns. When you open an e-mail sent with Pardot, a file contained in the e-mail (so-called web-beacon) connects to the servers of Pardot. In this way it can be determined whether a newsletter message has been opened and which links have been clicked on, if any. Technical information is also recorded (e.g. time of access, browser type and operating system). This information cannot be assigned to the respective newsletter recipient. It is used exclusively for statistical analysis of our newsletter campaigns.

We have a legitimate interest in being able to measure the success of our newsletters by means of statistical analyses not related to individual users, in order to improve our newsletters taking into account the results of the analyses and to make the newsletters more interesting for the recipients. The legal basis for the use of Pardot is Art. 6 para. 1 sentence 1 lit. f GDPR (processing is necessary to protect the legitimate interests of the controller).

Opt-out: If you do not wish the analysis in connection with our e-mail/newsletter campaigns, you can unsubscribe from the newsletter at any time, e.g. using the unsubscribe link included in every e-mail/newsletter.

c) Advertising cookies/services:

Facebook Website Custom Audiences

Our website uses the retargeting technology "Website Custom Audience" of the social network Facebook (Facebook Ireland Ltd. Hanover Ranch, 5-7 Hanover Quay, Dublin 2, Ireland) which enables us to show our website visitors who have already taken an interest in our website and our services and are Facebook members, also on Facebook through the Facebook Ad-network relevant advertisements and offers for them.

For this purpose, so-called Facebook retargeting pixels are integrated on our websites, which enable Facebook to record you as a visitor to our websites using a pseudonym and to use the data as the basis for our Facebook Ads on Facebook. Personal data will not be collected or saved from you and you are therefore not identifiable to us. Facebook does not link the data collected via the retargeting pixel with the user data stored on Facebook about your person. Please note that the aforementioned tracking procedure enables Facebook to identify a user via numerous websites.

We have a legitimate interest in being able to display advertising and offers relevant to Facebook to our website visitors who have already shown interest in our offers and are also Facebook members. The legal basis for the use of Facebook Custom Audience is Art. 6 para. 1 sentence 1 lit. f GDPR (processing is necessary to protect the legitimate interests of the controller).

Opt-out: You can object to the use of Facebook Website Custom Audiences for the future via https://www.facebook.com/settings/?tab=ads and http://www.youronlinechoices.com/de/praferenzmanagement/. You can find more information on data protection and your setting options in this regard at https://www.facebook.com/settings/?tab=ads and https://www.facebook.com/about/privacy/.

You can also set your web browser to reject all cookies or only cookies from third parties.
